Laws are written rules of law prepared by the legislator with the aim of protecting the order of a society and regulating relations between individuals, and they are binding. Legality criteria, on the other hand, are systematic standards established subsequently to determine the applicability of laws and their legal limits. For laws to be applied without error, it is necessary not only to identify the criteria for legal compliance fully and accurately, but also for those applying the law to be well acquainted with them.
Criteria for legal compliance indicate whether a particular behaviour, transaction or activity is acceptable within the legal framework. Although they are closely linked to the text of the law, they can sometimes be difficult to distinguish and understand. Failure to adhere sufficiently to legislative technique and legal language when drafting legal texts, the inclusion of unnecessary and lengthy explanations in legal texts, or the intensive use of abstract or technical concepts are important factors that complicate the identification of criteria for compliance with the law. On the other hand, the fact that legal texts are often open to interpretation and that the same law can be interpreted differently by different individuals, institutions or courts is also a factor that complicates the determination of criteria for compliance with the law.
The contribution of awareness of the criteria for compliance with the law and their correct understanding can be observed in practice from the legislative activity stage onwards. By taking compliance criteria into account, certain errors and omissions in draft laws can be rectified before these texts become law. Furthermore, by considering these criteria when implementing laws, the administration can apply laws with fewer errors and more accurately identify any errors in implementation. Furthermore, it is clear that a full and accurate understanding of the criteria for legal compliance contributes positively to reducing legal disputes and resolving them quickly.
As the positive results of knowing the criteria for legal compliance in practice become apparent, the importance of accurately identifying these criteria and making them known to the wider public is also becoming better understood. It is clear that efforts in this direction will be laborious but necessary. This is because the cost of efforts to prevent application errors by ensuring a better understanding of the law will not be as heavy as the cost of remedying non-compliance with the law and the resulting grievances.
