Law drafting technique includes the methods that must be followed to prepare clear and applicable legal texts. Although there is no binding legislation on this subject in our country, the Guidelines for Preparing Draft Legislation published by the Presidency of the Grand National Assembly of Turkiye in 2019 and the Legislative Handbook published in 2022 are the main sources in this field.

According to these regulations, law proposals submitted to the Grand National Assembly of Turkiye must be structured in a specific manner and contain various divisions such as books, parts, sections, and articles. Provisions that are sequentially listed in law texts and contain different regulations in terms of content are called articles, and these articles are composed of parts such as paragraphs, clauses, sub-clauses, sentences, and phrases. Each paragraph in a law article is numbered in parentheses "( )", clauses are indicated by letters, and a half parenthesis ")" is placed after these letters. All letters in the Turkish alphabet are used in the sequencing of clauses. Sub-clauses within a clause are also numbered, as in paragraphs, but sub-clause numbers are closed with a half parenthesis ")" unlike paragraph numbers.

Another important aspect from the perspective of law drafting technique is the order in which the articles in the text of the law are arranged. Considering the needs, the articles of the law are generally arranged as follows: purpose, scope, definitions, establishment, bodies, qualifications, duties, powers and responsibilities, penal provisions, provisions relating to regulatory procedures, amended and repealed provisions, transitional provisions, and provisions on entry into force and implementation. Tables, lists, diagrams and other appendices relating to the enacted provisions are included in the final section of the law.

Finally, it would be useful to briefly mention the writing technique used when amending laws. When changes are to be made to laws and it is not possible to make these changes to one of the existing articles, additional articles are usually added to the laws. Additional articles are added before the transitional provisions and are numbered sequentially. However, if the new article to be added needs to be placed within a specific part of the law, it is numbered with the article number preceding it and the uppercase letters "ARTICLE.../A,B,C..." in the relevant section, thus eliminating the need to renumber the articles in the subsequent section.

In this article, we have briefly mentioned the law drafting technique currently used in our country. It is clear that the care taken in drafting laws will help maintain social order by allowing them to be understood and implemented more accurately.
